A Day in the Portsmouth General District Court – Traffic Division

Anthony Montagna, III handles DUI’s, reckless driving cases, other traffic violations, and criminal charges  on a regular basis.  Recently, Anthony separately defended three individuals charged with reckless driving in Portsmouth, VA.

The first case involved an individual charged with reckless driving at 107 mph in a 55 mph zone.  The trooper also advised Anthony that he believed the individual also reached a speed of 127 mph.

The second case involved an individual charged with reckless driving at 89 mph in a 45 mph zone. This case also involved allegations of road rage.

The third case involved an individual charged with reckless driving for failing to move over with the trooper on the side of the road with his emergency lights flashing. This charge is particulary serious because it places police officers and troopers in danger of being injured.

Although each case is different and results in one case do not predict or guarantee results in other cases, Anthony slayed the proverbial legal dragon. He ended his recent court day in the Portsmouth General District Court – Traffic Division with smashing results.

The first case was reduced to improper driving.  In VA improer driving is only a traffic infraction.

The case had the reckless driving charge reduced to speeding, 19 miles per hour over the speed limit.  Speeding is also only a traffic infraction.

The third reckless driving charge was dismissed with a warning.  The client was very happy.
